Waste Collection Queen's Park Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Queen's Park provides waste collection and related services to residential and commercial customers. By booking a waste collection service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation requesting the waste collection service.

Service means any waste collection, removal, loading, clearance, or related service provided by Waste Collection Queen's Park.

Waste means the materials, rubbish, refuse or items presented by the Customer for collection as part of the Service.

Vehicle means any vehicle, truck or van used by Waste Collection Queen's Park to perform the Service.

Terms means these Terms and Conditions, as amended from time to time in accordance with clause 13.

2. Scope of Service

Waste Collection Queen's Park provides waste collection services within defined service areas and on agreed dates and times, subject to availability. The Service may include the loading of Waste into our Vehicle, transportation, and disposal or recycling of Waste at an authorised facility, in accordance with applicable waste management regulations.

The specific details of the Service, including the type and approximate volume of Waste, access requirements, and any special handling instructions, will be agreed at the time of booking. The Customer is responsible for ensuring that all information provided is accurate and complete.

3. Booking Process

3.1 Bookings can be made by telephone or through an online booking system where available. A booking is an offer by the Customer to purchase the Service in accordance with these Terms and Conditions.

3.2 Waste Collection Queen's Park will confirm acceptance of a booking verbally or in writing, including by email or booking confirmation message. A contract between the Customer and Waste Collection Queen's Park is formed only when such confirmation is issued.

3.3 The Customer must provide the following information at the time of booking:

a. Full name, contact number and service address.

b. Description of the Waste, including approximate volume or number of items.

c. Any access restrictions, parking requirements or timing constraints.

d. Any known hazards or special requirements related to the Waste.

3.4 Waste Collection Queen's Park reserves the right to refuse any booking where the Waste is not suitable for collection, where safe access cannot be provided, or where providing the Service would breach applicable regulations or pose unacceptable risk to staff or the public.

4. Service Delivery and Access

4.1 Waste Collection Queen's Park will use reasonable endeavours to attend the service address on the agreed date and within the agreed time window. However, all arrival times are estimates and are subject to traffic, weather, access conditions and operational constraints.

4.2 The Customer must ensure that adequate access is available for the Vehicle and staff, including any necessary parking permissions, gate codes, or building access arrangements. Any parking charges or penalties incurred as a result of insufficient or incorrect information provided by the Customer may be charged to the Customer.

4.3 If our staff are unable to gain access to the service address or collect the Waste due to circumstances within the Customer's control, this may be treated as a failed collection. In such cases, Waste Collection Queen's Park may charge a call-out fee or retain any pre-paid amount to cover costs incurred.

4.4 The Customer or an authorised representative should be present at the service address during collection. If no one is present, the Customer authorises Waste Collection Queen's Park to access the Waste as described at the time of booking. Where this is not possible, the collection may be rescheduled and additional charges may apply.

5. Description and Presentation of Waste

5.1 The Customer is responsible for accurately describing the Waste to be collected. This includes identifying bulky items, construction or garden materials, and any items requiring special handling.

5.2 Waste must be presented in a safe and accessible manner, so that it can be loaded without unreasonable risk to staff or damage to property. Loose small items should be bagged or contained where appropriate.

5.3 Waste Collection Queen's Park reserves the right to refuse to collect Waste that:

a. Differs materially from the description given at booking.

b. Includes hazardous, toxic, explosive or otherwise prohibited materials.

c. Is contaminated with substances that render it unsuitable for transport or disposal under relevant regulations.

5.4 If the volume or nature of the Waste exceeds the amount booked, additional charges may apply. In some cases, a further booking may be required to complete the collection.

6. Prohibited and Hazardous Waste

6.1 Unless expressly agreed in writing prior to the booking, Waste Collection Queen's Park does not collect hazardous waste, including but not limited to:

a. Asbestos or materials containing asbestos.

b. Clinical or medical waste.

c. Chemicals, solvents, oils, paints or pressurised containers.

d. Gas cylinders, fuel, flammable or explosive substances.

e. Radioactive materials or any other waste classified as hazardous under applicable law.

6.2 The Customer warrants that no prohibited or hazardous Waste will be presented for collection unless this has been notified in advance and agreed as part of a specific arrangement, in accordance with all relevant regulations.

6.3 If hazardous or prohibited Waste is discovered during collection or after loading, Waste Collection Queen's Park may take such steps as it considers appropriate to ensure safe handling, including returning the Waste, isolating it or notifying relevant authorities. Any resulting costs, including additional disposal charges, will be payable by the Customer.

7. Pricing, Quotes and Payments

7.1 Prices for the Service are based on the type and estimated volume or weight of the Waste, the level of labour required, and the location of the service address. Quotes given prior to collection are estimates based on information provided by the Customer.

7.2 Waste Collection Queen's Park reserves the right to revise the price on arrival if the Waste differs from the description, if access is significantly more difficult than described, or if additional labour or Vehicle capacity is required. Any revised price will be agreed with the Customer before the Service is carried out.

7.3 Unless otherwise agreed, payment is due on completion of the Service. Waste Collection Queen's Park may require full or partial payment in advance, particularly for large or commercial collections.

7.4 Payment may be made by cash, debit card, credit card, bank transfer or any other method agreed by Waste Collection Queen's Park. The Customer acknowledges that failure to make payment in full when due may result in the withholding of the Service or, where Waste has already been collected, the commencement of recovery proceedings for any unpaid sums.

7.5 All prices are quoted exclusive of any applicable taxes or government charges, which will be added to the invoice at the prevailing rate where applicable.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a booking by contacting Waste Collection Queen's Park within normal working hours. Any cancellation or amendment must be confirmed by us to be effective.

8.2 Where a booking is cancelled by the Customer with sufficient notice prior to the agreed collection time, any pre-paid amounts may be refunded or applied to a future booking, subject to any administrative charges disclosed at the time of booking.

8.3 Waste Collection Queen's Park reserves the right to charge a cancellation fee where:

a. The Customer cancels with short notice before the scheduled collection time.

b. Our staff have already been dispatched or have arrived at the service address.

c. Access cannot be obtained due to circumstances within the Customer's control.

8.4 Waste Collection Queen's Park may cancel or reschedule a booking at any time where:

a. It is unable to perform the Service due to circumstances beyond its reasonable control.

b. The Customer fails to provide accurate information or necessary access.

c. Proceeding with the Service would be unsafe or unlawful.

In such cases, any pre-paid amounts for the unperformed part of the Service will be refunded or reallocated to a new booking.

9. Liability and Damage

9.1 Waste Collection Queen's Park will perform the Service with reasonable skill and care. However, the Customer acknowledges that the loading and removal of Waste may involve movement of items and access through property, which can carry a risk of minor damage.

9.2 The Customer is responsible for identifying and notifying our staff of any fragile areas, surfaces, fixtures, or items that may require particular caution. Reasonable steps will be taken to avoid damage, but Waste Collection Queen's Park shall not be liable for wear and tear, pre-existing damage, or damage arising from defects in the Customer's property.

9.3 Waste Collection Queen's Park shall not be liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Service, whether in contract, tort or otherwise.

9.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited under applicable law.

9.5 If Waste Collection Queen's Park is found liable for any direct loss or damage to the Customer's property, such liability shall, to the extent permitted by law, be limited to the reasonable cost of repair or replacement, up to a maximum aggregate amount per incident as specified in any applicable insurance policy.

10. Waste Handling and Regulatory Compliance

10.1 Waste Collection Queen's Park will transport and dispose of Waste in accordance with applicable waste management, environmental and duty of care regulations, and will use authorised disposal or recycling facilities.

10.2 Title to the Waste shall pass to Waste Collection Queen's Park once it is loaded onto the Vehicle, unless otherwise agreed in writing. Thereafter, Waste Collection Queen's Park shall be responsible for the Waste until it is transferred to an authorised facility.

10.3 The Customer remains responsible for ensuring that the Waste presented for collection does not breach any legal restrictions. If the Customer presents Waste in breach of this obligation, the Customer shall indemnify Waste Collection Queen's Park against any loss, cost, penalty or claim arising as a result.

11. Customer Responsibilities

11.1 The Customer agrees to:

a. Provide accurate information about the Waste and access arrangements at the time of booking.

b. Ensure safe and reasonable access for our staff and Vehicle.

c. Secure any necessary consents, permits or approvals required for the collection, including parking permissions.

d. Refrain from instructing our staff to undertake any action that is unsafe, unlawful, or outside the agreed scope of the Service.

11.2 The Customer acknowledges that any failure to comply with these responsibilities may result in additional charges, delays, or cancellation of the Service.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Service, they should contact Waste Collection Queen's Park as soon as possible, providing full details of the issue and any supporting information.

12.2 Waste Collection Queen's Park will investigate complaints in a timely manner and, where appropriate, propose a resolution, which may include re-attending the property, a partial refund, or other remedial action.

12.3 Nothing in this clause affects the Customer's statutory rights under applicable consumer law.

13. Changes to Terms and Conditions

13.1 Waste Collection Queen's Park reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to the Customer.

13.2 The Terms and Conditions in force at the time of booking will apply to that booking, unless a change is required by law or regulation, in which case the updated terms may apply.

14. Data Protection and Privacy

14.1 Waste Collection Queen's Park collects and processes personal information necessary to provide the Service, including contact details, service address and payment information.

14.2 Personal data will be handled in accordance with applicable data protection law and will only be used for the purposes of providing and administering the Service, fulfilling legal obligations, and, where permitted, for service-related communications.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

16.2 No failure or delay by Waste Collection Queen's Park to exercise any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.

16.3 The Customer may not assign or transfer any of their rights or obligations under these Terms without the prior written consent of Waste Collection Queen's Park. Waste Collection Queen's Park may assign or subcontract its rights and obligations where necessary for the performance of the Service.

16.4 These Terms and Conditions constitute the entire agreement between the Customer and Waste Collection Queen's Park in relation to the Service and supersede any prior discussions, correspondence or understandings.
